Special Issue  Supreme Court Rules on the ACA

On Thursday, the nation's highest court ruled that every provision of the Patient Protection and Affordable Care Act, commonly known as "The ACA" or "Obamacare" is constitutional.

 

In its ruling, the judges upheld even the most controversial provisions of the law, including the "individual mandate" requiring individuals to purchase health insurance or pay a progressively higher fine beginning in 2014.  Many news outlets have raced to report on all of the possible political ramifications of today's ruling .

 

A couple of interesting things to note:

 

1.  The court ruled that the individual mandate was permissible not under the Interstate Commerce Act, but under Congress' constitutional right to tax the populace.

 

2.  The court did limit Congress' ability to coerce states into participating in the expansion of Medicaid by threatening to withhold federal payments (which pay for about 90% of the program).

 

What does the ruling mean for physicians?

Regardless of the "spin" your political stripe puts on the rulings or the outcome of November's election, what these rulings mean is that at least for the interim, healthcare reform measures will continue to move forward without the doubts raised by pending legal challenges, and repeal will become more and more unlikely.

 

What's Next?

In practical terms, the changes we predicted last November are much more likely to come to pass (and a lot of them could actually be good news for medical practices, if not for politicians and insurance companies).
